Abstract
This case deals with the intricacies of international contracting in the export-import business, including the problems of exchange rate fluctuations. The case specifically focuses on the export contract of Super Traders Ltd, Bombay (an export house), with the Textile Trading Corporation, Tedda (Tedda Arab Kingdom), concluded in 1964 on a principal to principal basis (leaving internal contracting to be done by Super Traders Limited with local mills in Bombay, subject to certain provisions of the above-mentioned contract) for the supply of canvas cloth to be supplied by the importer to the Allied Arabian Armies based in Tedda. The operation of this contract led to claims and counterclaims of defaults by the parties involved. The implications of invoking force majeure clause in such contracts are also brought out in the case.
