Abstract
Deals with the problem of handling an undisciplined employee at a bank's branch office. The employee, who is an active union member, has an unflattering performance record. Repeated memos from the branch manager fail to improve his performance. Ultimately, the branch manager, with the concurrence of the head office, conducts a domestic inquiry and terminates his services on the ground of gross misconduct. The employee, with the help of his union, files a suit in a civil court alleging victimization by the management for his union activities. The case raises important issues regarding the division of the personnel function between the head office and the branches.
