Abstract
In 2024, the Supreme Court of India decided a long-pending dispute between the Delhi Metro Rail Corporation (DMRC) and the Delhi Airport Metro Express Private Limited (DAMEPL) in favour of the former by setting aside an arbitral award of about ₹8,000 crores. Later, it issued contempt notices to the DAMEPL and Axis Bank for not refunding an amount of about ₹2,600 crores to the DMRC. Further, in March 2025 it again ordered compliance in letter and spirit. Several questions arise. Was the dispute resolution clause ambiguous? Did the DAMEPL depend heavily on the termination clause? Is challenging an arbitral award too complex and uncertain?
