Abstract
The role of the Supreme Court in formulating a policy to ameliorate air quality control in Delhi is an example of judicial activism. It can be said to be necessary due to lack of effective action by the legislature and the executive. The creation of the Commission for Air Quality Management (CAQM) in 2021 has been due to persistence of the Supreme Court. Although, air quality control, monitoring and management fall within the purview of various government institutions, the Supreme Court nonetheless supervises the functioning of the administrative apparatus regularly. This has led to a situation wherein the separation of powers between the legislature/executive and the judiciary occasionally becomes blurred.
